Terms and Conditions: Entitled1 Art Division

1. Introduction and Scope

1.1 These Terms and Conditions (“Terms”) govern the sale of all artworks, including originals, limited editions, sculptures, and commissioned pieces (“Artwork”) by Entitled1 (“the Gallery”, “We”, “Us”) to the customer (“You”). 1.2 By placing an order via our website, email, or in person, you agree to be bound by these Terms to the exclusion of any other terms.

2. Pricing and Payment

2.1 Prices: All prices are quoted in GBP. While we strive for accuracy, we reserve the right to correct pricing errors. If an error is discovered after an order is placed, we will give you the option to reconfirm at the correct price or cancel.

2.2 VAT & Duties: Prices include UK VAT where applicable. For international orders, the recipient is responsible for all import duties, customs fees, and local taxes.

2.3 Payment: Artwork will not be released until full payment is received in cleared funds. We accept bank transfers and major credit/debit cards. 2.4 Finance: Any finance agreements are provided by third-party lenders and are subject to separate credit approval and terms.

3. Delivery and Collection

3.1 Collection: You may opt to collect your Artwork from our London office by prior appointment. Collection must occur within 14 days of notification that the Artwork is ready.

3.2 Delivery Timeline: We aim to deliver all Artwork within 4 weeks of cleared payment. This window allows for professional archival packing, bespoke framing (where applicable), and specialist courier scheduling. We will notify you of any unforeseen delays.

3.3 Shipping: We arrange specialist art couriers for global delivery. Shipping costs and insurance will be quoted separately unless otherwise stated.

3.4 International Delivery: Entitled1 acts as the exporter. It is your responsibility to ensure the Artwork can be legally imported into your destination country.

4. Inspection and Damage

4.1 Immediate Inspection: You must inspect the Artwork immediately upon receipt.

4.2 Reporting Damage: Any damage or discrepancies must be reported to us in writing (including photographic evidence) within 48 hours of delivery or collection.

4.3 Transit Risk: If you choose to use your own courier, risk passes to you the moment the Artwork leaves our London office.

5. Cancellations and Returns

5.1 Distance Selling: For online or telephone purchases only, UK consumers have the right to cancel within 14 days of receipt.

5.2 Exclusions: This right does not apply to:

• Artwork purchased or viewed in person prior to purchase.
• Bespoke, commissioned, or personalized pieces (including custom framing).

5.3 Return Process: Artwork must be returned in its original condition and packaging. You are responsible for return shipping costs and must use a specialist art courier. We recommend insuring the return for the full value.

6. Originality and Reproduction Rights

6.1 Exclusivity of Originals: Entitled1 guarantees that where an Artwork is sold as an “Original,” it is a unique work. We will never produce or sell another original version of that specific work.

6.2 Limited Edition Rights: The Gallery and the Artist reserve the right to use the image of an original Artwork to create and sell Limited Edition prints, multiples, or digital assets.

6.3 Intellectual Property: Purchase of the Artwork does not grant you any copyright or reproduction rights. You may not reproduce the image of the Artwork for commercial gain.

7. Authenticity and Condition

7.1 COA: Where applicable, Artworks are supplied with a Certificate of Authenticity. This is a vital document for provenance and should be stored securely.

7.2 Variation: Small variations in color, texture, or finish are inherent in original and hand-finished works and are not considered defects.

8. Investment Disclaimer

8.1 Entitled1 sells Artwork for aesthetic enjoyment. We do not provide financial or investment advice. While art can appreciate in value, past performance is no guarantee of future returns.

9. Limitation of Liability

9.1 Our total liability for any claim shall not exceed the price paid for the Artwork. 9.2 We are not liable for damage caused by:

• Normal wear and tear or natural aging.
• Environmental factors (e.g., humidity, direct sunlight, extreme temperatures).
• Third-party framing or cleaning services not authorized by Entitled1.

10. Governing Law

10.1 These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
